These terms are an agreement between you and Tose’e Ertebatat-e Ra’d (Mindio) (“we”, “us”) about your use of capshak, the website and the video editor. By creating an account or using capshak, you agree to them. If you do not agree, please do not use capshak.
Your account
- You need an account to use the editor. Sign in with your own mobile number and keep access to it, since sign-in codes are texted to that number. Never share a sign-in code.
- You are responsible for everything done with your account. If you think someone else has access, use “sign out everywhere” in Account, then tell us.
- One person per account. Do not share, sell or transfer your account.
- If you are under 18, you need permission from a parent or guardian. capshak is not for children under 13.
Acceptable use
You must follow our Acceptable Use Policy. It explains what you may not create or do with capshak. Breaking it is a breach of these terms.
Your content
Your videos, audio, captions, texts and projects belong to you. We do not claim ownership of anything you create or upload.
To run the service, you give us a limited, non-exclusive, worldwide licence to store, process, copy and transmit your content only as needed to provide capshak to you. This includes sending audio to speech-to-text providers, sending caption text to AI providers for translation and proofreading, keeping your project documents, and keeping optional video backups. This licence ends when you delete the content or your account, except for copies we must keep by law.
You confirm that you have the rights needed for everything you put into capshak, including music, footage, pictures and fonts.
Content you add from GIPHY, Freesound or Jamendo is licensed by those services and their creators, not by us. Check and follow their licence terms. Stickers, sound effects and music in capshak’s own library may be used in the videos you make with capshak.
AI features
capshak uses AI for transcription, proofreading, translation and the AI editor.
- AI output can be wrong. Transcripts may contain mistakes, translations may miss meaning, and the AI editor may make changes you did not expect.
- Always review captions, translations and edits before you publish. You are responsible for what you publish.
- Every AI editor request is one undo step, so you can undo it all at once.
- We do not guarantee that AI output is accurate, complete or fit for a particular purpose.
Credits and payment
- Paid features, such as transcription, translation, proofreading and the AI editor, use credits. Editing, styling, effects and export are free.
- Current packages and costs are on the pricing page. We may change prices for future purchases. This does not affect credits you already have.
- Credits do not expire.
- Credits are not transferable to another account and are not cash. They cannot be exchanged for money, except as described in our Refund Policy.
- Credits are reserved when a job starts and settled on actual use. If a job fails, the reserved credits are released automatically.
- Free credits given at sign-up or in promotions have no cash value and cannot be refunded.
- Payments are processed by Zarinpal (in toman) or Stripe (in USD).
Availability
We work to keep capshak running well, but we do not promise it will always be available, error-free or uninterrupted. We may change, add or remove features. Some features depend on your browser and device. capshak works best in recent desktop browsers that support WebCodecs.
Video backups are a convenience, not long-term storage. They are deleted after the retention period. Keep your own copy of your original files.
Limitation of liability
capshak is provided “as is”. To the extent the law allows:
- We are not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data or lost opportunities.
- We are not responsible for content you publish, or for decisions you make based on AI output.
- Our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law.
Termination
You can stop using capshak at any time and ask us to delete your account by email.
We may suspend or close your account if you seriously or repeatedly break these terms or the Acceptable Use Policy, if required by law, or to protect other users or the service. Where reasonable, we will tell you first and explain why. If we close your account without a breach on your part, we will refund your unused paid credits.
Governing law
For users in Iran, these terms are governed by the laws of the Islamic Republic of Iran, and disputes are handled by the competent courts of Iran. For users elsewhere, these terms are also governed by the laws of the Islamic Republic of Iran, without removing any consumer protections that the law of your country gives you and that cannot be waived.
We prefer to solve problems directly, so please contact us first.
Changes to these terms
We may update these terms. We will change the date at the top, and for important changes we will let you know by email or in the app before they take effect. If you keep using capshak after the change, you accept the new terms.
